The deadline to identify your rustic and mixed properties completely free of charge is about to end. According to the latest data, the Single Property Desk (BUPi) has already managed to identify about 46% of the mainland territory's area, but thousands of plots of land remain at risk due to a lack of official delimitation.
The Real Estate Law team at Global Lawyers warns of the urgency of regularizing these properties and the risks of missing this deadline:
1. The End of the Cost Exemption The great attraction of the BUPi platform has been the possibility of identifying the boundaries of land and promoting registration at the Land Registry Office with total exemption from fees and charges. With the end of this free period just a few days away, those who do not regularize their situation will have to bear the legal costs associated with these acts.
2. Being Registered with the Tax Authority is Not Enough Many owners believe that having the land registered in the Tax Authority's matrix (Finanças) and paying IMI (Municipal Property Tax) is sufficient proof of ownership. This is a serious mistake. The Tax Authority only collects taxes, it does not guarantee ownership or physical limits. Only registration at the Land Registry Office (now coordinated with identification in BUPi) provides full legal protection.
3. Blocked Sales and Inheritances Failure to identify rustic land is paralyzing business. Without delimitation in BUPi, it becomes increasingly difficult (and in many cases, impossible) to sign deeds of purchase and sale or carry out fair and swift partitions in inheritance processes, generating unnecessary disputes with neighbors and heirs.
4. The Risk of Loss to the State Rustic properties that remain without a known owner and without identification in the registry may, in the future, be considered land without a titleholder, running the risk of joining the land bank managed by the State.
Regularize before you pay Identifying land requires reconciling old documentation (often outdated) with current matrices. The Real Estate team at Global Lawyers provides all the legal support in locating, delimiting, and registering your family heritage so that you do not lose your rights or pay unnecessary fees.
