Ethics and Integrity in Sports: An Analysis of the Disciplinary Legal Framework
The recent UEFA Champions League match between Sport Lisboa e Benfica and Real Madrid C.F. has once again brought to the forefront the discussion on the fundamental values that should govern international competitions. Beyond the findings of facts, which fall exclusively under the jurisdiction of disciplinary bodies, this episode serves as a starting point for an analysis of the protection of human dignity on the pitch and the legal consequences of breaching conduct duties.
The UEFA and FIFA Regulatory Framework
The preservation of sporting integrity finds a fundamental pillar in Article 14 of the UEFA Disciplinary Regulations. This rule states that any participant who insults human dignity — whether on grounds of race, color, religion, gender, or sexual orientation — faces a minimum ten-match suspension.
This sanction underscores the individual nature of the responsibility of players, coaches, and officials. This regulatory rigor is shared by FIFA, which, at its 74th Congress in 2024, reaffirmed its global commitment to sporting ethics, consolidating a zero-tolerance policy towards discriminatory acts in all their forms.
The Legislative Framework in Portugal
At the national level, the Portuguese legislator has established a robust framework to ensure safety and ethics in sporting events:
Law No. 39/2009: Defines the legal regime for combating violence and intolerance in sports.
Criminal Code (Article 240): Criminalizes discrimination and incitement to hatred and violence.
Law No. 93/2017: Strengthens the regime for preventing and combating discrimination based on racial or ethnic origin.
This legal order is in full accordance with European Union Directive 2000/43/EC, which enshrines the principle of equal treatment, and with the guidelines of the Council of Europe.
Effectiveness on the Pitch
The integrity of football does not depend on the creation of new regulations, but on the consistent and proportional application of existing instruments. The existence of deterrent norms is the first step; speed and firmness in their application are what guarantee the credibility of competitions.
When sporting values are defended structurally and consistently, sport is strengthened. On the field, disciplinary bodies are required to act with the rigor provided for in their own statutes, ensuring that football remains a space of mutual respect and dignity.
